Important: federal hemp law changes on December 11, 2026

Section 781 of Public Law 119-37, signed on November 12, 2025, narrows the federal definition of hemp. From December 11, 2026, a finished consumer product containing more than 0.4 milligrams of total THC per retail container falls outside that definition and is treated as a controlled substance under federal law. The measurement standard also shifts from delta-9 THC alone to total THC, which includes THCA.

Most hemp-derived THC beverages and edibles currently on the market exceed that threshold. Products that stay below 0.4 milligrams of total THC per container are not affected, and products sold through state-licensed cannabis markets are governed by state law rather than the federal hemp definition.

On September 2, 2026, the President signed H.R. 6500, the Continuing Appropriations and Extensions Act, 2027, which moves most of this change to December 11, 2026. One part keeps the original date: products containing cannabinoids the cannabis plant cannot naturally produce still lose federal hemp status on November 12, 2026. The delay is tied to the continuing resolution, so the December funding deadline is the next decision point. The Lawful Hemp Protection Act, sponsored by Representatives Andy Barr of Kentucky and Angie Craig of Minnesota, would replace the limit with a regulatory framework but has not passed. The 2026 Farm Bill is unlikely to be the vehicle. The Senate Agriculture Committee failed to advance its version on a 10-11 vote on August 6, 2026, and House Agriculture Chairman Glenn Thompson has stated that regulating finished hemp products falls outside his committee’s jurisdiction.

Plan for December 11 and do not count on a second delay. Confirm the current federal position, and your own state rules, before making inventory, hiring, or training decisions.
