
Important: federal hemp law changes on November 12, 2026
Section 781 of Public Law 119-37, signed on November 12, 2025, narrows the federal definition of hemp. From November 12, 2026, a finished consumer product containing more than 0.4 milligrams of total THC per retail container falls outside that definition and is treated as a controlled substance under federal law. The measurement standard also shifts from delta-9 THC alone to total THC, which includes THCA.
Most hemp-derived THC beverages and edibles currently on the market exceed that threshold. Products that stay below 0.4 milligrams of total THC per container are not affected, and products sold through state-licensed cannabis markets are governed by state law rather than the federal hemp definition.
Two legislative paths remain open as of this writing. The Senate Appropriations Committee has proposed delaying the restriction on some intoxicating hemp products until December 11, 2026, attached to a continuing resolution funding the federal government. Separately, the Lawful Hemp Protection Act, sponsored by Representatives Andy Barr of Kentucky and Angie Craig of Minnesota, would provide broader relief. Neither has been enacted.
The 2026 Farm Bill is unlikely to be the vehicle. The Senate Agriculture Committee failed to advance its version on a 10-11 vote on August 6, 2026, and House Agriculture Chairman Glenn Thompson has stated that regulating finished hemp products falls outside his committee’s jurisdiction.
Plan for November 12 while watching for a delay. Confirm the current federal position, and your own state rules, before making inventory, hiring, or training decisions.
